About these terms
These terms are an agreement between you and Raccoon Ventures Inc., a Canadian corporation registered in Quebec, doing business as TrimCarbon (“TrimCarbon”, “we”, “us”), at 73C Boulevard des Prairies, Laval, Quebec H7N 2T2. They apply when you use trimcarbon.com, create an account, or buy through us (the “Service”). By creating an account or making a purchase, you accept them.
If you use TrimCarbon for a company, flight school or club, you confirm that you may accept these terms for it, and “you” includes it. Amounts above 15 tonnes of CO₂ a year are priced individually; if we sign a separate agreement with you, it prevails where it differs from these terms.
Our Privacy Policy explains how we handle personal information, and our Offset disclosures describe the projects behind the credits.
If you are a consumer, nothing in these terms takes away rights that the consumer protection laws of the place where you live give you and that a contract can't exclude. Where a clause below conflicts with such a law, the law wins.
Your account
- You must be at least 18, or the age of majority where you live if that is higher, to create an account or buy.
- Give us accurate information and keep your email address current. You must verify your email address before you can sign in.
- Keep your password to yourself. We recommend adding a passkey or two-factor authentication. Tell us right away at contact@mail.trimcarbon.com if you think someone else has used your account.
- You're responsible for what is done through your account, unless it results from our fault or from access you couldn't reasonably have prevented.
What TrimCarbon does
Emissions estimates
Our calculators estimate the carbon dioxide (CO₂) released by burning fuel, using a typical cruise fuel flow for each aircraft type and the hours you enter. They are approximations. They count combustion CO₂ only, not other greenhouse gases, contrails or other non-CO₂ effects, or the emissions from producing and transporting the fuel. Your actual emissions depend on how and where you fly. Don't rely on our estimates for regulatory reporting, such as CORSIA or an emissions trading scheme.
Carbon credits
When a payment succeeds, we order carbon credits for the amount of CO₂ it covers from our supplier, CNaught Inc. (“CNaught”). CNaught records the order in an account it keeps for you under our CNaught account, buys the credits, and retires them on a public carbon registry. Retiring a credit cancels it permanently, so nobody else can use or resell it. We place each order as soon as the payment succeeds, and keep retrying if CNaught is temporarily unavailable.
The account CNaught keeps for you is named with an internal ID, or with the name you choose for your certificates, and never with your email. Each certificate shows the account's name when CNaught issues it, and doesn't change after. If an order can't be placed or delivered, for example because CNaught stops operating, we either refund that payment or retire equivalent credits through another provider, at our choice.
- A carbon credit represents one tonne of CO₂ or equivalent gases reduced, avoided or removed by a project, as measured and verified under the project's standard. Orders are in kilograms.
- Credits come from a portfolio that CNaught selects and manages. It mixes projects that avoid or reduce emissions with projects that remove CO₂ from the atmosphere. CNaught chooses the projects and how each order is split between them; we don't select individual projects.
- We don't promise that your credits will come from a particular project, project type or country. The portfolio and its projects can change over time. The current ones are on our Offset disclosures page.
- Each order has a certificate you can open from your account. A certificate has a public web address, so anyone you share it with can see it.
- You are buying a service: the purchase and retirement of credits for you. You don't receive credits you can hold, transfer, resell or move to another registry account, and retired credits can't be un-retired.
What you can say about your purchase
Buying credits through TrimCarbon funds projects that reduce or remove emissions elsewhere. It does not remove the CO₂ your flights emit, and it does not make your flying “carbon neutral”, “net zero” or “climate neutral”. Please don't describe it that way.
A fair way to put it is, for example: “I funded the retirement of 2 tonnes of verified carbon credits through TrimCarbon”, with a link to your certificate.
Some laws restrict environmental claims. For example, in the European Union, claims that a product or activity has a neutral, reduced or positive climate impact because of offsetting are prohibited since September 27, 2026, and California requires businesses that make offset-based claims to publish details about them. If you make public claims based on your purchases, you are responsible for them.
Prices and taxes
- Prices are in US dollars and are shown on our pricing page and at checkout before you pay. Your bank may charge a currency conversion fee.
- Subscriptions are priced per kilogram of CO₂. Yearly plans get a lower rate per kilogram for larger amounts: the rate of the bracket that the year's total falls into applies to every kilogram in that year, so a slightly larger amount can cost less in total. Volume rates don't apply to monthly plans. The current rates and brackets are on our pricing page.
- The monthly plan has a minimum of 140 kg per month, and the yearly plan a minimum of 250 kg per year. Above 15 tonnes a year, we price individually: ask us through the contact form.
- A one-time purchase is 1 tonne (1,000 kg) for US$40.
- Prices don't include taxes. Where the law requires us to charge sales tax, GST/HST, QST, VAT or a similar tax, we add it at checkout and show it before you pay.
- If a price we show is obviously wrong, we'll tell you before charging and you can decide whether to go ahead at the correct price. This doesn't affect consumer laws that require us to honour a price we advertised.
Subscriptions
- What you buy: an amount of CO₂ per billing period, monthly or yearly. Each paid invoice orders credits for that period's amount; on the yearly plan, the whole year's credits are ordered when the yearly payment succeeds.
- When you're charged: through Stripe, in advance, when you subscribe and then at the start of each billing period, to the payment method you gave.
- Automatic renewal: your subscription renews automatically for another period of the same length, with the same amount of CO₂ and at the same price (unless we've given you notice of a price change), until you cancel. By subscribing, you authorize us to charge your payment method for each renewal. We show these renewal terms next to the subscribe button and again in Stripe Checkout. Once your plan starts, we email you its price, its renewal date and how to cancel.
- Changing the amount: to change the amount per period or switch between monthly and yearly, write to us, or use the billing portal (open it from your account) where it offers the change. You'll see how the change affects your charges before you confirm it.
- Cancelling: you can cancel at any time from the billing portal. Cancellation takes effect at the end of the period you have already paid for, and you won't be charged again. Credits already ordered for paid periods stay retired.
- Failed payments: if a renewal payment fails, Stripe will try again over the following days. We don't order credits for a period until it is paid. If the payment still fails, your subscription may be cancelled.
- Price changes: we'll email you at least 30 days before a new price applies to your subscription. If you don't want to continue at the new price, you can cancel before it takes effect, without cost.
One-time purchases
A one-time purchase is a single payment of US$40 (plus any applicable tax) for 1 tonne of CO₂. We order the credits as soon as the payment succeeds. It doesn't renew.
Refunds and withdrawal
We buy and retire the credits right after each payment, and a retired credit can't be taken back. That is why refunds work as follows.
- Your request at checkout: in Stripe Checkout, you tick a box to agree to these terms and to ask us to retire your credits right away. By ticking it, you also confirm that you understand that once your credits are retired, you can't cancel for a refund.
- Retired credits aren't refunded. Cancelling a subscription stops future payments.
- Charges made in error: if you were charged twice, charged the wrong amount, or charged after you cancelled, we refund the charge. Write to contact@mail.trimcarbon.com.
- If we can't deliver: if the credits a payment covers can't be ordered or retired, we either refund that payment or retire equivalent credits through another provider, at our choice (see Carbon credits). Refunds go back to the payment method you used.
- Consumers in the EU, EEA and UK: the law usually gives you 14 days to withdraw from a purchase made online. Because you expressly ask us at checkout to retire your credits right away, and acknowledge that you can't cancel for a refund once they're retired, you lose that right once your credits are retired.
- Consumers in Quebec: you keep every right the Consumer Protection Act gives you. For distance contracts, that includes cancelling within the periods the Act sets if we didn't give you the required information or a copy of the contract, and asking your card issuer to reverse the charge if we don't refund you after such a cancellation.
Nothing in this section limits rights that consumer law gives you and that a contract can't exclude, such as your rights under Quebec's Consumer Protection Act.
If something went wrong, write to us anyway: we'd rather fix it.
Acceptable use
Please don't:
- use the Service for anything unlawful or fraudulent;
- use a payment method you aren't authorized to use, or make purchases intended to be disputed;
- try to get around security features, rate limits or bot protection, access other people's accounts, or probe or disrupt our systems;
- create accounts automatically, or scrape or copy the Service at scale without our written permission;
- resell credits, certificates or the Service, or present yourself as a TrimCarbon partner, without a written agreement with us;
- use our certificates or name to make misleading environmental claims;
- upload images you don't have the right to use, or that are unlawful or offensive.
Intellectual property
The Service, including its software, text, calculators, design and the TrimCarbon name and logo, belongs to us or our licensors. You may use it for its intended purpose. You may share your certificates and say that you bought credits through TrimCarbon.
You keep the rights to the images you upload, such as a profile picture or organization logo. You allow us to store and display them to run the Service, until you remove them or delete your account.
Third-party services
- Stripe processes payments, subscriptions and the billing portal under its own terms and privacy policy. We never receive your full card details.
- CNaught buys and retires the credits. We are CNaught's customer, and CNaught is not a party to these terms. CNaught's own commitments, such as its guarantee to replace credits from projects that a registry cancels or suspends, are described on our Offset disclosures page.
- Carbon registries (such as Verra, ACR, the Climate Action Reserve, Gold Standard or Isometric) keep the official records of each project and retirement.
We aren't responsible for third-party websites we link to, or for the services of providers you deal with directly.
Changes to the service
We work to keep the Service available, but it may sometimes be interrupted for maintenance or by problems beyond our control. We may improve or change features. If a change significantly reduces what you pay for, we'll tell you in advance and you can cancel before your next payment. If we stop offering the Service, we'll give you at least 30 days' notice and won't charge you after it ends.
Disclaimers
To the extent the law allows:
- emissions estimates are approximations (see What TrimCarbon does);
- climate projects carry risks, such as a forest burning down or a project delivering less than projected. Registries and CNaught have safeguards against these (described on our Offset disclosures page), but we can't guarantee how a third-party project performs;
- apart from what these terms say, the Service is provided as it is and as available, without other promises.
This doesn't exclude the warranties and guarantees that consumer law gives you, such as the legal warranty under Quebec's Consumer Protection Act or your statutory rights in the EU and UK.
Limitation of liability
To the extent the law allows:
- we aren't liable for indirect or consequential losses, such as lost profits, lost business or loss of reputation;
- our total liability to you for all claims relating to the Service is limited to US$50.
These limits never apply to:
- liability that the law doesn't allow us to limit, including for intentional or gross fault, fraud, or death or bodily injury;
- consumers in Quebec, to the extent the Consumer Protection Act prohibits excluding or limiting a merchant's liability;
- consumers in the EU, EEA and UK, for loss that was a foreseeable result of our breaching these terms or failing to use reasonable care and skill.
Indemnity (business customers)
This section applies only if you use the Service for a business, school, club or other organization, not to consumers. You agree to cover our reasonable costs and losses from third-party claims arising from your breach of these terms, your unlawful use of the Service, or environmental claims you make about your purchases. We will tell you promptly about any such claim and let you take part in the defence.
Suspension and termination
You can stop at any time: cancel your subscription in the billing portal, or delete your account from the Account page. Deleting your account cancels any active subscription, so you won't be charged again.
We may suspend or close your account if you seriously or repeatedly breach these terms, if you use the Service fraudulently or unlawfully, or if the law requires it. Except in urgent cases (such as fraud, a security risk or a legal requirement), we'll tell you first and give you a chance to fix the problem. If we close your account for a reason other than your breach, we refund any amount you paid for credits that haven't been retired yet.
After an account is closed, retired credits and their records remain with CNaught and the registries. Sections that by their nature should continue (such as intellectual property, limitation of liability and governing law) continue to apply.
Governing law and disputes
- These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there.
- If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and you can bring a claim in the courts there if those laws allow it.
- Otherwise, the courts of the Province of Quebec, judicial district of Laval, have jurisdiction.
- Please tell us about a problem first, at contact@mail.trimcarbon.com. We aim to resolve it within 30 days. This never stops you from going to court or to a consumer protection authority.
- Quebec consumers: nothing in these terms prevents you from bringing a claim before a court, including the Small Claims Division, or from taking part in a class action.
- These terms contain no arbitration clause and no class action waiver.
Language
These terms are available in English, French, German and Portuguese. If the versions differ, the English version prevails, except where the law gives the French version precedence (for example, for consumers in Quebec).
Changes to these terms
We may change these terms, for example when the Service or the law changes. If a change affects you, we'll email you at least 7 days before it takes effect, or longer where the law requires. For consumers in Quebec, that is at least 30 days and no more than 90 days. The email will show the new or changed clause, the version it replaces, and the date it takes effect.
If you don't agree, you can cancel your subscription or close your account without cost or penalty before the change takes effect. Quebec consumers can also do so within 30 days after it takes effect. Changes don't apply to payments made before they take effect.
Emails from us
We send emails that are part of the Service to your account address: email verification, sign-in codes, password resets, receipts, order confirmations, subscription notices, notices under these terms, and a one-time welcome email from our founder. You receive them whatever your marketing choice.
We send marketing emails only if you opt in, with the checkbox at sign-up or the setting on the Account page. You can withdraw at any time on the Account page or with the unsubscribe link in any marketing email.
General
- These terms, together with the policies they link to, are the whole agreement between you and us about the Service.
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- We may transfer this agreement to a business that takes over the Service, and will tell you if we do; your rights under it won't be reduced. You may not transfer it without our consent.
- We aren't responsible for delays caused by events beyond our reasonable control, such as an outage at a registry or supplier. We will complete what we can as soon as we can.
Notice to California users
Under California Civil Code section 1789.3, California users are entitled to this notice: if a complaint is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
